CANDIDATE PRIVACY POLICY
We respect the privacy rights of parties and are committed to handling personal data responsibly and in accordance with applicable regulation. This Policy explains how we manage your personal data when you apply for a career or other position with us and the constitutional rights you have in relation to that data. It is important that you understand this Policy thoroughly and precisely.
SCOPE
This Policy regulates our handling of Candidate Data anywhere in the globe in relation with our recruitment of Candidates for opportunities with us. This Policy does not apply to us processing of personal data in relation with the use of our goods or services. COLLECTION OF CANDIDATE DATA
This Policy covers the data you share with us and/or which may be attained or generated by us during the application or recruitment process including:
- names, address, electronic mail address, telephone number and other communication data
- resume, cover letter, preceding and/or related employment experience or other experience, education, records, or additional data you convey to us in aid of an application and/or recruitment process.
- Records from interviews and phone-examinations you may have, if applicable.
- Specifics of the kind of employment you have or may be pursuing for, current and/or desired salary and other conditions relating to compensation and benefits bundles, willingness to relocate, or other employment preferences.
- Specifics of how you learned about the position you are applying for.
- Any vulnerable and/or demographic data managed during the application or employment process such as gender, data about your citizenship and/or ethnic group, medical or health data and/or your racial or ethnic origin.
- Reference data and/or data received from background screenings (where applicable), including data provided by third parties.
- Referee and referrer’s names and contact information (referrer must obtain permission from referee prior to delivering referee’s personal data).
- Data relating to any past applications you may have made to us and/or any former employment history with us.
- Your data from publicly accessible sources, including electronically, that we consider is crucial to your application or a potential future application (e.g., Recruiting Agency). This comprises data provided by references that you provide.
- Any other data you willingly make available during the process, including online, through interviews or other forms of evaluation.
USE OF CANDIDATE DATA
We use your Candidate Data in connection with our Candidate recruitment process. For example, we use your Candidate Data to:
- Evaluate your skills, qualifications, and interests in connection to our opportunities.
- Authenticate your data and conduct reference checks and/or conduct background examinations (where applicable) if you are offered an opportunity.
- Form a means of communication with you about the employment procedure and/or your application(s), including, in applicable cases, notifying you of other potential career opportunities with us.
- Generate and/or submit reports as required under any local laws and/or guidelines, where applicable.
- Where requested by you, assist you with getting an immigration visa or work permit where required.
- Making enhancements to our application and/or employment procedure including developing diversity in employment systems. If we use your data to develop our application or employment procedure, we do so on the basis that it is in our reasonable interests to ensure we recruit the most excellent candidates.
- Obey with valid laws, guidelines, legal processes, or enforceable legislative requests.
- Proactively perform research about your educational and professional experience and skills and contact you if we believe you would be appropriate for a position with us.
- As part of our promise to equal opportunity employment, we may process data regarding your affiliation in various organizations to strengthen our diversity and inclusion efforts. This may include associating participant affiliation with sensitive and/or demographic information.
If you are hired, we will preserve your Candidate Data as part of your employee records. If you are not hired for the position for which you were primarily considered, we may use your Candidate Data to recognize and contact you about other opportunities for which you may want to be considered. If you do not wish for us to use your data for this intent, you may request that we destroy your Candidate Data by contacting us.
In addition, if you provide us with the contact information of your references, we may utilize that data to contact your references (and not for any other purpose), this may include sharing your personal data with your referees. Data provided by such references will be utilized by us to assess your candidacy and will otherwise be managed in agreement with this Policy.
We may also seek your consent to process your personal data in certain situations or process it where necessary to comply with a legal responsibility or for reasons associated with legal claims.
WHO MAY HAVE ACCESS TO YOUR DATA
To conduct the objectives defined above, your personal data may be shared internally with administrators, human resources and recruitment teams, systems administrators, and other members of our staff for our recruitment procedures.
- Your data may be shared with our affiliates, subsidiaries, or joint ventures in Canada and in other jurisdictions, in relation to the purposes defined above. If you have been referred for an opportunity with us by our current employee, with your permission, we may inform that employee about the advancement of your application and let our employee know the outcome of the process. In some instances, if it is found that you have attended the same educational facility or shared the same previous employer during the same period as our current employee, we may discuss with that employee for any criticism of you.
- We may engage third-party vendors to perform services on our behalf and these third parties must process personal data to provide their services. Examples include: (a) recruiting or executive search agencies involved in your recruiting; (b) background checking or other screening providers and relevant local criminal records checking agencies; (c) data storage, shared services and recruiting platform providers, IT developers and support providers and providers of hosting services in relation to our careers internet site; and (d) third parties who provide support and advice including in relation to legal, financial/audit, management consultancy, insurance, health and safety, security and intel and whistleblowing/reporting issues; and these service providers may be established outside the nation in which you live or the nation where the position you have applied for is located.
- We may sometimes be required to disclose your data to peripheral third parties such as to local labor authorities, courts and tribunals, regulatory bodies and/or law enforcement agencies for the purpose of complying with relevant laws and regulations, or in response to legal process.
- In connection with, or during negotiations of, any amalgamation, sale of our assets, consolidation or reorganization, financing, or acquisition of all or a portion of our company by or into another company.
- In an aggregated and/or anonymized form which cannot realistically be used to distinguish you.
- To identify, prevent or otherwise address fraud, security, or technical matters, or to protect against harm to the rights, property, or safety of us, our users, applicants, candidates, employees, or the public or as otherwise required by law.
- It is your responsibility to get consent from referees prior to providing their personal data to us.
- We operate globally, which implies your data may be stored and managed outside of the nation or area where it was formerly collected as well as in Canada. In some of these nations, you may have less privileges regarding your data than you do in your nation of residence. Irrespective of where your data is managed, we use the same/comparable protections defined in this Policy.
We take appropriate procedures to safeguard data about you that is gathered, managed, and stored as part of the application and employment procedure. We do not sell Candidate personal data.
CANDIDATE DATA RETENTION AND DELETION
If you apply for a career opportunity with us and your application is unsuccessful (or you withdraw from the process or decline our offer), we preserve your Candidate Data for a period after your application. This period is defined in agreement with the laws in the nation where you reside. These regulations may require us to preserve your data for periods defined in such laws, or to delete it after periods defined in those laws. Unless otherwise mandatory by such regulations, we may preserve your Candidate Data for 48 calendar months after it ceases to consider you for an opportunity with us, and will thereafter destroy your Candidate Data excluding for historical data regarding the opportunity for which you were considered (e.g., the position(s) for which you applied and the dates of your application(s)), and the decisions made by us with respect to your application (which may consist of the arguments for the decision). In some instances, we may request for your consent to preserve your Candidate Data for longer than the period otherwise allowed under appropriate laws.
You may also request deletion of your Candidate Data at any time. Unless otherwise obligatory by law, or where we may have a valid interest that defends continued preservation, we will delete your Candidate Data after receiving such request, except for historical data concerning the positions for which you were considered, and the decisions made by us with respect to your application.
YOUR RIGHTS IN RESPECT OF YOUR DATA
In certain nations, you may have certain rights under data protection law. This may consist of the right to request access or to update or review your data, request that it be destroyed or anonymized, or object to or restrict us from using it for some reasons.
For example, Candidates located in the United Kingdom, Switzerland and the European Economic Area may request access to the personal data we process, and/or to ask that we update, correct, restrict the scope of use of or delete the personal data that we process. You may also be eligible to object to the processing of your personal data or to request portability of your personal data. Depending on the area in which you work you may have other constitutional rights in relation to your personal data. For instance, if you are employed in France, you may have the right to give instructions regarding the use of your personal data after your death.

Please note that these disclosures do not apply to our management of data gathered about you in your role as an individual who interacts with us while using our products and services. When you cooperate with us as in that role, our Privacy Policy associated with the relevant service applies.
INFORMATION FOR CANDIDATES IN THE EUROPEAN ECONOMIC AREA (EEA)
We manage your personal data pursuant to one or more of the following lawful grounds:
- The processing is necessary to take steps, at your request, relating to potentially entering an employment contract with you.
- The processing is necessary to comply with our legal responsibilities, such as preserving records relating to the employment procedure for periods necessary under relevant laws.
- The processing is necessary in connection with our justifiable interests in recruiting and employing the best candidates. For example, we process your Candidate Data to assess and improve the effectiveness of our employment procedure or maintain historical records of the employment procedure and the outcomes of that process.
- We may also seek your consent to process or retain your Candidate Data in certain situations. For example, we may ask for your consent to retain your data so that you may be considered for future occupation opportunities with us.
INTERNATIONAL TRANSFER OF CANDIDATE DATA
If you are applying for an opportunity with us from outside of Canada, the Candidate Data that we collect about you in the recruitment process may be moved to, and stored on, our servers, located in Canada/US. Authorized personnel of us and/or affiliated companies at locations outside Canada may have access to your Candidate Data as part of the recruitment process. If you live outside Canada, including in the EEA, we transfer your Candidate Data based on Standard Contractual Clauses, or other systems approved by the European Commission at the time of.
CALIFORNIA CONSUMER PRIVACY ACT DISCLOSURES
Under the California Consumer Privacy Act (“CCPA”), if you are a resident of California, we are obliged to provide you with further data about how we collect, utilize, and disclose personal data as defined under California law. These disclosures should be read in conjunction with our other policies concerning California residents such as our Privacy Policy.
CHANGES TO THIS POLICY
