FOR LAW ENFORCEMENT POLICY
We provide logistics solutions and beyond, globally. As a component of our responsibility to safety, we have a committed team that acts in response to requests for data from law enforcement and public health representatives. This assistance is available 24/7. We appreciate the effort law enforcement organizations do to keep people protected around the globe. We are willing to carefully review, authenticate and respond to law enforcement requests based on relevant law and Policy. The following operational regulations are for law enforcement officials requesting records from us.
RESPONDING TO LAW ENFORCEMENT REQUESTS
In addition to this Policy, law enforcement officials may also contact us with inquiries or in emergency situations as detailed below. To ensure a timely response, please do not send law enforcement inquiries to our support team or any other channel not intended for law enforcement.
LEGAL PROCESS CONDITIONS
We disclose account records exclusively in accordance with our Terms of Service and relevant law, including the federal Stored Communications Act (“SCA”), 18 U.S.C. Sections 2701-2712.
INTERNATIONAL LEGAL PROCESS CONDITIONS
We will evaluate whether requests are dependable with internationally recognized standards including human rights, due process, and the rule of law. A Mutual Legal Support Treaty request or letter rogatory may be necessary to compel the release of the contents of an account.
ACCOUNT PRESERVATION
We will take measures to preserve account data in relation with official criminal investigations for 90 days pending our receipt of formal legal process. You may expeditiously submit formal preservation requests through our Law Enforcement Online Request System as indicated below.
EMERGENCY REQUESTS
In responding to a subject concerning imminent harm to a minor or danger of death or severe physical injury to any individual and needing release of information without delay, a law enforcement official may submit a request through our Law Enforcement Online Request System. For accelerated processing of such requests, we recommend containing the word “EMERGENCY” in the summary of your request.
Please note, we will not examine or reply to requests submitted by non-law enforcement officials. Please submit emergency requests from an official government-issued electronic mail address. Parties aware of an emergency should instantly contact their local law enforcement directly.
DATA PRESERVATION AND AVAILABILITY
We will search for and release data that is specified with accuracy in an applicable form of legal process and which we are able to locate and retrieve. We do not preserve data for law enforcement reasons unless we receive a valid preservation request before a user has deleted that content from our platform. This may include data about how some users interact with others on our platform.
As indicated in our Terms of Service and Policy, we may collect, use, preserve, and share user data if we have a good-faith belief that it is essential to (a) keep our users safe, (b) identify, investigate, and prevent unlawful activity, (c) respond to legal process, or to government requests, (d) enforce our terms and policies.
FORM OF REQUESTS
We will be incapable of managing overly broad or vague requests. All requests must identify requested data with accuracy and include the following:
- The name of the issuing agency, badge or ID number of responsible official, electronic mail address from a law enforcement domain and direct contact phone number or an extension
- User identifying data/fields in our platform.
USER CONSENT
If a law enforcement official is requesting data regarding our user who has provided consent for the official to access or acquire the user’s account data, the user should be instructed to acquire that data on their own from their account or by contacting us. Some users can access our request account info feature on their own account, where applicable.
NOTIFICATION
We reserve the right to inform users who use our platform of requests for their data prior to release unless we are prohibited by law from doing so or in extraordinary circumstances, such as child cases, emergencies or when notice would be counterproductive.
COST REIMBURSEMENT
We may seek compensation for expenses in responding to requests for data as required by law. These fees apply on a per account basis. We may also charge additional fees for expenses incurred in responding to unusual or burdensome requests. We may waive these fees in matters investigating harm to children, us, and our users or for emergency requests.
SUBMISSION OF REQUESTS
Law enforcement officials may utilize our Law Enforcement Online Request System for the submission and processing of requests. A government-issued electronic mail address is required to submit in our Law Enforcement Online Request System.
Law enforcement officials who do not submit requests through our Law Enforcement Online Request System should expect delayed response time. Sending requests both electronically and through hard copy can also increase the processing time.
Note:
- Acceptance of legal process by any of these means is for convenience and does not waive any objections, including lack of authority or proper service.
- We will not respond to communication sent by non-law enforcement officials to the contact below.
REQUEST GATEWAY
By submitting a request, you are accepting that you are a government official making a request in your official capability. Data released by us is intended to be used exclusively for law enforcement and public safety purposes and may not be shared with any third parties.
This gateway may be used to submit emergency disclosure requests to the extent they are consistent with Canadian and local law by:
- Acknowledging the Terms & Conditions, Law Enforcement Policy, and related policies
- Authenticating your electronic mail address and providing your contact information
- Verifying that your request relates to an emergency involving danger of death or severe physical harm necessitating disclosure without delay of data relating to that emergency.
- Verifying that you are presently unable to acquire legal process.
CHANGES TO THIS POLICY
The content of this Policy is for your general information and use only. These policies are subject to modification without notice. You acknowledge that this information may contain inaccuracies or errors and is subject to adjustment and we expressly omit liability for any such inaccuracies or errors to the fullest degree authorized by law. We urge you to regularly review this page (and all available policies & agreements) for the latest information on the Policy. Your continued use of our platform and internet sites constitutes your agreement to be obliged by such amendments to this Policy. Your only remedy, if you do not agree to the terms of this Policy, is to cease use of and access to our platform and internet sites.
