INDEPENDENT CONTRACTOR DEFINITION
An independent contractor, as per this policy, refers to an individual or entity that provides services to us under a contractual arrangement. The independent contractor operates independently and is not considered an employee of ours. Independent contractors are solely responsible for their own business operations, expenses, and liability.
SCREENING PROCESS: BASIC STANDARD REQUIREMENTS
To be eligible to join our partners’ team as an independent contractor, applicants must meet the following basic standard requirements:
- Proof of at least $2 million in Commercial General Liability (CGL) insurance coverage – for longer than 2 years duration with clean history.
- Proof of at least $2 million in Commercial Auto Policy – for longer than 2 years duration with clean history.
- Documentation verifying a minimum of 2 years of commercial driving experience. In instances where you are offering passenger services to our organization, a standard prerequisite for any hiring is the provision of 3 years of experience in that specific field.
SCREENING PROCESS: APPLICATION PROCESS
Applicants interested in becoming independent contractors with us must submit their applications through the designated channels provided by us. The application should include relevant documents such as a resume, driving history, insurance details, letter of experience, and any other information requested by us.
SCREENING PROCESS: SCREENING AND EVALUATION
We will carefully evaluate each applicant’s qualifications and experience to determine their suitability for partnership. The screening process may include, but is not limited to:
- Reviewing driving records, including any previous accidents or violations.
- Verifying the applicant’s commercial driving experience.
- Verifying insurance coverage and its validity.
- Conducting interviews (after or before screening) and assessments to evaluate the applicant’s skills and capabilities.
COMPLIANCE WITH OUR PROTOCOLS
All applicants seeking to become independent contractors with us must agree to comply with all protocols and guidelines set forth by us. These protocols may include, but are not limited to, safety procedures, operational guidelines, and any other relevant policies.
DELAY OR REJECTION DUE TO NON-COMPLIANCE
Non-compliance with our protocols or guidelines during the application process may lead to delays in the evaluation process or possible rejection of the application. We expect applicants to demonstrate their dedication to safety, professionalism, and adherence to all relevant regulations. For instance, failing to follow our protocol for application submission through our designated online portals may result in complications. It is important to note that not all levels of our management have access to application status updates. Therefore, applicants will be contacted by our recruitment team only after successful completion of the application process via our online portal, unless otherwise instructed.
COMMUNICATION GUIDELINES: EMAIL THREADS
To ensure efficient and effective communication during the application process, all applicants are requested to maintain single email threads for correspondence with us. This approach will streamline communication and enable better tracking of the application progress.
COMMUNICATION GUIDELINES: RESPONSE TIME
Applicants should be aware that response times from us may vary and can take up to 3 weeks. We will make our best efforts to respond promptly, but due to operational demands, response times might be extended. Urgent matters should be communicated through the appropriate channels as specified by us.
DISCLAIMER OF LIABILITY AND ASSET OWNERSHIP
We wish to underscore the paramount importance of applicants recognizing that all decisions regarding purchases, acquisitions, or investments related to equipment, vehicles, or any other assets necessary for service provision are entirely at their own discretion and risk throughout the independent contractor screening process.
In most instances, possessing the requisite assets, including vehicles and equipment, is considered a fundamental prerequisite for initiating the application process. Applicants are expected to have ownership of the assets essential for contracted services prior to commencing their application.
Any financial commitments made by applicants, encompassing the acquisition of vehicles or equipment, are undertaken entirely at their own risk. We explicitly disclaim any responsibility or liability for the outcomes of these financial investments, emphasizing our commitment to neither compensate nor be held accountable for any resulting financial losses arising from the procurement, upkeep, or utilization of assets associated with the independent contractor position.
We, along with our officers, employees, agents, and representatives, shall not bear any accountability for the condition, performance, or suitability of any equipment, vehicle, or related assets owned or acquired by applicants. We absolve ourselves of responsibility for any losses, damages, or liabilities incurred as a consequence of these investments, expecting applicants to autonomously navigate the risks associated with their financial commitments in assets, ensuring strict adherence to the standards outlined by us.
Prior to any financial commitments, applicants are strongly urged to thoroughly review the specific criteria and guidelines pertaining to the suitability of assets delineated by us in the screening process. It is the sole responsibility of applicants to ensure possession of the requisite assets in full compliance with our established standards, and any misrepresentation may result in the rejection of the application.
Moreover, applicants are advised that this Disclaimer of Liability and Authority holds precedence over any verbal or written statements made by our employees or associates. By progressing with the application process, applicants acknowledge and affirm their comprehension and acceptance of the terms encapsulated within this Disclaimer of Liability and Authority. We steadfastly maintain that any financial or operational risks associated with asset ownership exclusively rest with the applicant.
NOTICE OF JOB POSTING CANCELLATION POLICY
Applicants are advised that job postings may be subject to cancellation at any point in time. In the event of such cancellation, regardless of the application process stage, the applicant’s submission will be terminated.
As a matter of courtesy and at the discretion of our organization, applicants may be considered for potential future opportunities with similar service requirements. However, the decision to either fill or terminate a position, due to organizational needs or other considerations, remains entirely within our purview. We want to clarify that we bear no liability for any consequences or obligations to the applicant should a job posting be canceled, or a position terminated.
We appreciate the understanding and cooperation of applicants in recognizing the dynamic nature of our hiring requirements. The cessation of a job posting, for any reason, does not imply any contractual obligation or liability on our part toward the applicant. Applicants are encouraged to remain informed and acknowledge the potential for such adjustments throughout the application process.
TIME AND COMPENSATION
The screening process may take up to 4 months for completion. During this period, applicants will not be compensated in any form for their time or efforts involved in the screening process. We reserve the right to modify the screening process timeline based on operational requirements and other factors.
APPLICATION REJECTION BASED ON SUPPLIES, QUALIFICATIONS, AND VEHICLE CRITERIA
We reserve the right to reject an applicant’s application based on the supplies and vehicle used to provide services to us. The rejection may occur if the applicant’s vehicle does not meet our specified criteria or if the vehicle contains decals or markings that are deemed unsuitable by us.
Applicants are required to present authentic and verifiable qualifications relevant to the services they aim to offer as independent contractors. We retain the right to reject an application if the applicant’s qualifications do not meet the minimum standards set by us. Qualifications criteria may encompass educational background, certifications, licenses, and professional experience in the said industry.
Applicants are required to ensure that their vehicles meet our specified criteria for safe and efficient service provision. The criteria may include but are not limited to:
- Compliance with local and federal regulations governing the type of vehicle and its cargo capacity.
- Proper maintenance records demonstrating regular vehicle servicing and upkeep.
- Adherence to emission standards and other environmental requirements.
We maintain the right to assess the suitability of any decals or markings on an applicant’s vehicle, including those related to advertising, graphics, or offensive content. If the decals or markings are deemed unsuitable by us, the application may be rejected.
Applicants acknowledge that they are solely responsible for ensuring that their supplies, qualifications and vehicles meet our specified criteria and adhere to any guidelines provided by us. We reserve the right to reject an application based on its assessment of the applicant’s supplies and vehicle.
MISUSE OF RESOURCES AND TIME MANAGEMENT
We are committed to maintaining the efficiency and integrity of our operations. Any applicant found to be misusing our resources, purposely not following guidelines, or wasting valuable time during the screening process will be subject to the following penalties:
MISUSE OF RESOURCES AND TIME MANAGEMENT: RESOURCE COST PENALTY
If an applicant is found to be misusing our resources, such as proprietary information, tools, or facilities, the applicant will be liable for a penalty of up to $5,000, representing the cost of the resources misused.
MISUSE OF RESOURCES AND TIME MANAGEMENT: TIME WASTAGE PENALTY
Applicants are expected to value the time and efforts invested by both us and them during the screening process. Excessive delays or uncooperative behavior that result in time wastage will be subject to a penalty of $1,500 per month for each month that such delays occur.
NO GUARANTEE OF POSITION OR SERVICE PROVIDING OPPORTUNITY
Submitting an application to become an independent contractor with us does not guarantee any individual or entity a position or service providing opportunity with us. All applicants must complete the full screening process, and a formal service offer letter from our management is required to secure a contractual partnership with us.
DISCLAIMER OF LIABILITY
We shall not be held liable for any losses, damages, or expenses incurred by applicants during the screening process, including but not limited to travel expenses, communication costs, or opportunity costs related to potential engagements. We are not responsible for any financial or non-financial losses arising from participation in the screening process, including the rejection of an application.
EXEMPTION FROM LIABILITY
Applicants agree to release and hold us, our officers, employees, agents, and representatives harmless from any and all claims, demands, causes of action, or liabilities arising out of or related to the screening process or any aspect of the application process.
AGREEMENT
By submitting your application, or inquiry to become an independent contractor with us, applicants acknowledge that they have read, understood, and agreed to abide by the terms and conditions outlined in this policy, including the no-guarantee clause, the disclaimer of liability, and the application rejection based on supplies, qualifications, and vehicle criteria.
CHANGES TO THIS POLICY
The content of this Policy is for your general information and use only. These policies are subject to modification without notice. You acknowledge that this information may contain inaccuracies or errors and is subject to adjustment and we expressly omit liability for any such inaccuracies or errors to the fullest degree authorized by law. Your continued use of our platform and internet sites constitutes your agreement to be obliged by such amendments to this Policy.
